Welcome to FixHub Pro. These Terms of Service ("Terms") govern your access to and use of the FixHub Pro mobile application and website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
Important: Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.
1. Description of Service
FixHub Pro is a platform that connects customers seeking home services with independent service providers ("Providers"). We facilitate the booking and payment process but do not directly provide home services.
- For Customers: You can browse available services, request quotes, book appointments, and pay for services through our platform.
- For Providers: You can create a profile, receive service requests, manage your availability, and receive payments through our platform.
2. Eligibility
To use our Service, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable law
- Provide accurate and complete registration information
3. Account Registration
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
4. Service Provider Requirements
If you register as a Provider, you additionally agree to:
- Maintain all required insurance (Workers Compensation and General Liability) for your services
- If registered as Licensed: maintain valid professional license
- If registered as Unlicensed: only accept jobs that do NOT require city permits
- Provide services in a professional and workmanlike manner
- Comply with all applicable laws and regulations
- Accurately represent your qualifications and experience
- Respond to customer inquiries in a timely manner
- Complete background verification as required by FixHub Pro
5. Booking and Payments
For Customers:
- Service fees and pricing are displayed before booking confirmation
- Payment is processed securely through Stripe
- You authorize us to charge your payment method for services booked
- Cancellation policies vary by service type and Provider
For Providers:
- FixHub Pro charges a platform fee on each completed transaction
- Payments are processed through Stripe Connect
- You are responsible for reporting and paying applicable taxes on your earnings
- Payment schedules and methods are subject to Stripe's terms
6. Platform Fees
FixHub Pro charges the following fees:
- Customer Transaction Fee: 4% added to the subtotal at checkout
- Provider Platform Fee: 12% deducted from the provider's payment
- Withdrawal Fee: $0 - Free withdrawals to bank accounts
- Fee amounts are displayed transparently before transaction completion
- Fees are subject to change with notice to users
Example: If a provider charges $100 for a service, the customer pays $104 (including 4% fee). The provider receives $88 (after 12% platform fee). The platform receives $16 total.
7. Withdrawal Rules
For service providers withdrawing their earnings:
- Minimum Withdrawal: $1
- Processing Time: 1-3 business days
- Withdrawal Fee: Free to bank accounts
- Provider must have a verified bank account on file
- Withdrawals are processed through Stripe Connect
8. Provider Requirements
All service providers must meet the following requirements:
- Valid Specialty: Must specialize in Electrical, Plumbing, or HVAC
- Workers Compensation Insurance: Active coverage required for ALL providers
- General Liability Insurance: Active coverage required for ALL providers
- Professional License: Required for Licensed providers only
- Unlicensed Providers: May only accept jobs that do NOT require city permits (repairs, maintenance, minor fixes)
- Document Updates: Insurance (and license if applicable) must be updated before expiration
- For Companies: Valid EIN and business documentation required
Providers with expired documents will have their accounts suspended until documents are updated and verified.
9. Licensed vs Unlicensed Providers
FixHub Pro supports two types of service providers:
Licensed Providers:
- Hold a valid professional license in their specialty
- Can accept all types of jobs, including those requiring city permits
- Identified by a green "Licensed" badge in the app
Unlicensed Providers:
- Do NOT hold a professional license
- MUST maintain both Workers Compensation and General Liability Insurance
- Can ONLY accept jobs that do NOT require city permits
- Limited to repairs, maintenance, cleaning, and minor fixes
- Identified by an orange "Not Licensed" badge in the app
Customer Notice: Before hiring any provider, verify their license status displayed in the app. Customers who hire unlicensed providers for work that requires permits do so at their own risk. FixHub Pro recommends using licensed providers for any work that may require city permits or inspections.
10. Bonus Programs
Provider Cash Bonus:
- Earn $500 for every 10 qualifying jobs completed
- Jobs with invoice total ≥$2,000 qualify automatically
- Jobs with invoice total $1,300-$2,000 AND 5-star customer review qualify
- Track progress via the gift icon in the app
- Bonuses are unlimited - counter resets after each payout
Customer Discount Program:
- Earn $150 discount for every 6 qualifying jobs completed
- Jobs must have invoice total of at least $200 to qualify
- Maximum 2 jobs per specialty count toward discount
- High-value jobs ($2,000+) qualify automatically
- Discount is applied automatically to your next invoice
11. User Conduct
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws, regulations, or third-party rights
- Post false, misleading, or fraudulent content
- Harass, abuse, or harm other users
- Interfere with or disrupt the Service or servers
- Attempt to circumvent the platform to avoid fees
- Create multiple accounts or impersonate others
- Use automated systems to access the Service without permission
12. Reviews and Ratings
Our review system helps maintain quality and trust:
- Reviews must be honest and based on actual experiences
- We reserve the right to remove reviews that violate our policies
- You may not offer incentives for positive reviews
- Both Customers and Providers may leave reviews after service completion
13. Intellectual Property
The Service and its contents, including but not limited to text, graphics, logos, and software, are the property of FixHub Pro and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee:
- The quality, safety, or legality of services provided by Providers
- The qualifications or credentials of any Provider
- That the Service will be uninterrupted or error-free
- The accuracy of any information on the platform
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXHUB PRO SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Any damages resulting from services performed by Providers
- Any damages exceeding the amount paid by you for services in the past 12 months
16. Indemnification
You agree to indemnify and hold harmless FixHub Pro, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Services you provide or receive through the platform
17. Dispute Resolution
Any disputes arising from these Terms or your use of the Service will be resolved through:
- Informal Resolution: We encourage you to contact us first to resolve any issues
- Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in Miami, Florida
- Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions
18. Termination
We may suspend or terminate your account at any time for:
- Violation of these Terms
- Fraudulent or illegal activity
- Behavior that harms other users or our reputation
- Extended periods of inactivity
Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will remain in effect.
19. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
20. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions.
21. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
